Terms of Service

These Terms of Service (“Terms”) apply to services provided by SafelySituated™ Home Assessments, LLC (“SafelySituated,” “we,” “us,” or “our”), including in-person home assessments, virtual home reviews, follow-up calls, and the Annual Safety Refresh (the “Services”). By booking or using the Services, you agree to these Terms.

1. Scope of Services
SafelySituated provides non-medical environmental home safety assessments. After your assessment, you receive a written Roadmap (such as the Family Assurance Roadmap™) with prioritized recommendations for your home. We are consultants, not contractors — we do not perform construction, installation, modification, or repair work. Current services and fees are listed on our website.

2. Non-Medical Services
Although our founder has a background in occupational therapy, the Services do not constitute medical advice, diagnosis, or occupational therapy, and do not establish a healthcare provider relationship. Please consult your healthcare providers about specific medical conditions or physical needs.

3. Independence
We do not accept commissions, referral fees, or other compensation from contractors, architects, product manufacturers, or vendors. Our recommendations are based on our observations of your home and your family’s needs.

4. Your Responsibilities
You agree to:

  • provide accurate information about the home and the people who live there

  • if the home is not yours (for example, a parent’s home), have the resident’s or owner’s permission to schedule the assessment and for us to enter and photograph the home

  • provide safe access to the areas being assessed and supervise children and pets during the visit

  • for virtual home reviews, show the areas we ask to see as clearly as possible

5. Photos and Video
You consent to our taking photos and video of the home during your assessment, or recording images shared during a virtual home review. These are used only to prepare your Roadmap and are handled as described in our Privacy Policy.

6. Fees and Payment
Fees are those listed on our website at the time of booking, unless otherwise agreed in writing. Payment is due on the day of your assessment or virtual home review, as stated on your invoice.

7. Cancellations and Rescheduling

  • Please give us at least 48 hours’ notice if you need to cancel or reschedule, so we can offer the time to another family. There is no fee to cancel or reschedule.

  • Fees are non-refundable once your assessment or virtual home review has taken place.

  • If we need to reschedule, we will work with you to find a new time.

8. Virtual Home Review Limitations
Virtual home reviews are limited to what you show us by video. While we apply the same professional approach, a virtual review may not identify every concern an in-person visit could.

9. Intellectual Property
Your Roadmap is created for your home and is intended for your personal use and for the architects, contractors, or other professionals you choose. Our methodology — including the Expert Eye Approach™ and the Environmental Micro-Stressors™ framework — is the proprietary intellectual property of SafelySituated. It may not be reproduced or used for commercial purposes without our written consent.

10. No Guarantee; Limitation of Liability
Our recommendations are advisory. We identify potential environmental concerns based on our professional experience, but we do not guarantee specific outcomes and cannot prevent all accidents or injuries. Decisions about whether and how to implement recommendations rest with you and the professionals you choose, and we are not responsible for the quality of work performed by third parties. To the fullest extent permitted by law, our total liability for any claim related to the Services is limited to the fees you paid for those Services.

11. The Pryor Project™
Pro bono assessments through The Pryor Project are provided at our discretion. Submitting a nomination does not guarantee an assessment. These Terms apply to pro bono assessments, except that no fee is charged.

12. Privacy
Our Privacy Policy explains how we collect, use, and protect your information.

13. Governing Law
These Terms are governed by the laws of the State of California. Any disputes will be resolved in the state or federal courts located in Orange County, California.

14. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date shows when they were last revised. The Terms in effect when you book apply to that booking.
